Terms of Use

The agreement between you and us when you use the Fast Job mobile application.

1. About These Terms

These Terms of Use ("Terms") govern your access to and use of the Fast Job mobile application ("App"), operated by Robin Paul Garaboeuf, ABN 48 991 983 945, trading as Fast Job ("we", "us", "our").

By creating an account or using the App you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

These Terms are governed by the laws of New South Wales, Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of New South Wales.

2. Eligibility

You must be at least 18 years old and legally permitted to work in Australia to use the App as a Worker.

You must be an authorised representative of a business registered in Australia to use the App as a Recruiter.

By using the App you represent and warrant that you meet these requirements.

You also represent that you are not located in, under the control of, or a national or resident of any country embargoed by the United States or Australian government, and that you are not on any U.S. or Australian government list of prohibited or restricted parties.

3. Account Registration

You must provide accurate, current and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials.

You must notify us immediately at contact@fast-jobs.com.au if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. The Fast Jobs Platform

Fast Job is a platform that connects Workers (individuals seeking casual or daily employment in construction, hospitality, and related industries) with Recruiters (businesses seeking short-term staff).

We are a technology intermediary only. We do not employ Workers, guarantee the availability of jobs, or guarantee that Recruiters will find suitable candidates. Any engagement between a Worker and a Recruiter is a direct arrangement between those parties and constitutes a real-world service performed off-app.

We do not verify the accuracy of job postings or Worker profiles beyond basic identity checks. You rely on information provided by other users at your own risk.

5. Worker Subscription

Workers may be required to maintain an active subscription to apply for jobs posted on the App. The current pricing, billing period, and any free trial period are displayed in the App before you confirm payment.

Subscription fees are processed by Stripe, Inc. as our payment processor (not through Apple in-app purchase, since the underlying service — securing real-world employment with a Recruiter — is performed outside the App). Subscriptions auto-renew unless cancelled before the next billing date.

To cancel your subscription, open the App's account settings and tap "Manage subscription". Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods, except where required by the Australian Consumer Law.

We reserve the right to change subscription pricing with 14 days' written notice. Continued use after the effective date constitutes acceptance of the new pricing.

6. Recruiter Job Postings

Recruiters may pay a fee per job posting where applicable. Such fees cover processing and are non-refundable once the job is published, except where required by Australian Consumer Law.

Job postings must accurately describe the role, location, hours, pay rate, and any requirements. Misleading postings may result in account suspension.

Last-minute job postings trigger push notifications to eligible Workers within an automatically-selected radius (10 to 20 km depending on local worker density). We do not guarantee delivery to any specific number of Workers.

We reserve the right to remove any job posting that violates these Terms or applicable law without notice.

7. User Conduct

You agree not to:

  • Post false, misleading or fraudulent information
  • Harass, threaten or discriminate against other users
  • Use the App to facilitate unlawful employment arrangements or circumvent minimum wage obligations under the Fair Work Act 2009 (Cth)
  • Attempt to bypass, disable or interfere with any security features of the App
  • Scrape, copy or redistribute any content from the App without our written consent
  • Use the App for any purpose other than seeking or offering lawful employment
  • Submit objectionable, offensive, or illegal content; we operate a zero-tolerance policy and will remove offending content and users without notice

We reserve the right to remove content and suspend or permanently ban accounts that breach this clause.

8. Ratings and Reviews

Workers and Recruiters may leave ratings and reviews after a completed engagement. Ratings must be honest and based on genuine experience.

Once submitted, a rating cannot be edited or deleted by its author. We reserve the right to remove ratings that are abusive, false or posted in bad faith.

Ratings are used to calculate reliability and recommendation scores displayed on user profiles. These scores are indicative only and do not constitute a reference or endorsement.

9. Push Notifications

By enabling push notifications you consent to receiving alerts regarding job opportunities, application updates, and platform communications.

You may manage your notification preferences at any time from the App's Notification Settings screen. Disabling OS-level notifications will prevent all push notifications regardless of in-app settings.

10. Intellectual Property

All content, trademarks, logos, and software in the App are owned by or licensed to Robin Paul Garaboeuf (ABN 48 991 983 945). You must not reproduce, distribute or create derivative works without our prior written consent.

By submitting content (profile information, photos, reviews) you grant us a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content for the purpose of operating the App.

11. Privacy

We collect and process personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Please read our Privacy Policy carefully before using the App.

Your home address (Workers) is used solely to match you with nearby job opportunities and is never shared with Recruiters.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by Australian law.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We are not liable for any loss arising from reliance on information provided by other users.

13. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law, our total liability to you for any claim arising out of or in connection with these Terms or the App will not exceed AUD $100 or the amount you paid us in the 3 months preceding the claim, whichever is greater.

We are not liable for any indirect, incidental, special or consequential loss including loss of income, data, business opportunity or reputation.

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty or other right you have under the Australian Consumer Law that cannot be excluded.

14. Third-Party Services

The App integrates third-party services including Supabase (data infrastructure), Stripe (payments), Mapbox (mapping and address autocomplete), and Expo (push notifications). Your use of these services is also governed by their respective terms and privacy policies.

We are not responsible for the availability, accuracy or practices of any third-party service.

15. Termination

You may delete your account at any time from the App settings. Deletion removes your profile data subject to our data retention obligations described in the Privacy Policy.

We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

Upon termination, your right to use the App ceases immediately. Outstanding subscription fees remain payable.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before the changes take effect.

Continued use of the App after the effective date constitutes your acceptance of the updated Terms.

17. Apple-Specific Terms (App Store version of the App)

The following clauses apply only when the App is downloaded from the Apple App Store and supplement the rest of these Terms.

  • This agreement is concluded between you and Robin Paul Garaboeuf only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • The licence granted to you for the App is limited to a non-transferable licence to use the App on any iOS-compatible device that you own or control, in accordance with the Apple App Store Terms of Service.
  • Apple has no obligation to furnish maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any, to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your use of it (including product liability, legal compliance, and intellectual property claims).
  • You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
